KOHLER BUY WITH EXCHANGE OFFER
TERMS AND CONDITIONS
- This “Buy with Exchange” offer (hereinafter referred to as “Scheme”) is being run by Kohler India Corporation Private Limited (“Company”) and shall commence on 01-Sep-2023 and is valid till 31-Dec-2024 unless terminated earlier at the sole discretion of the Company.
- This offer is valid only on Kohler Branded Products sold via its E-commerce platform www.shopkohler.in
- The scope of this Scheme is for a limited number of SKUs to be delivered at a limited number of pin codes which may increase or decrease at the sole discretion of the Company.
- The Exchange Offer shall be valid on the exchange of old sanitaryware fittings with the selective Kohler fittings. Kohler may collect the exchanged product from the customer's place at its sole discretion.
- Any dismantling of existing products or site modification or alteration (site readiness) including installation of the new Kohler Product shall be governed by “KOHLER D2C ONE-TIME INSTALLATION TERMS AND CONDITIONS” except the following which shall solely lie under the scope of the customer:
- Drilling holes in the countertop.
- Any electrical work required under the sink, i.e., installing a new electrical outlet.
- Any work related to modifying the customer’s space, i.e., cutting the wall, moving the water supply line, removing tile, replacing pipes etc.
- Labour and costs to add or move valve and/or associated plumbing not already present in the product’s project area.
- The relocation of existing products to another location in your home.
- Any other Labour, materials, and costs above and beyond the basic removal and replacement of the old product.
- The Company reserves the right to cancel, modify, extend, or withdraw the Scheme at its sole and absolute discretion without prior notice.
- The Company shall not be liable and responsible for any loss, injury or any other liability arising out of the Scheme. Company shall not be liable for any loss or damage due to Act of God, State governmental actions, policies and/or its subsequent changes, restrictions imposed and other force majeure circumstances. Also, to the maximum extent permissible under law, the Participant specifically agrees not to file in person/through any family member and/or any third party any applications, criminal and/or civil proceedings in any courts or forum in India against Company and/or its directors, employees, officers, affiliates or subsidiaries to claim any damages for any loss or opportunity, monetary loss or damages due to their participation in the Scheme.
- The terms and conditions of the Scheme shall be governed by Indian Laws. In case of any dispute, the decision of the Company shall be final and binding on the participants. Any and all disputes, controversies, and conflicts ("Disputes") arising out of the Scheme shall be subject to the exclusive jurisdiction of Courts at Gurugram, Haryana only.
- This Scheme is open for all Indian residents who are above the age of 18 (Eighteen) years.
- Participation in the Scheme is optional and by mere participation in the Scheme, the participant hereby provides his full and unconditional acceptance to all terms and conditions stipulated herein and agrees to be bound by all present and future terms and conditions.
- If any terms and conditions of the Scheme are found to be unlawful, void or for any reason non-executable, that provision will be deemed severable from these terms and conditions and will not affect the validity and enforceability of any remaining provision, unless it is practically not possible to administer the Scheme.
